09 Apr 1776. SOLICITOR’S LETTER ABOUT A COURT CASE. Bundle 47, Doc 27. 38 cm x 24 cm, folded in half to make four pages. Small round red seal with corresponding hole where letter was torn open. Several small pin holes. Docs 28-30 were wrapped into Doc 27 – they are all about the same case. Mr. BENSON to Mr. GRAHAM – 9. Aprl: 1776. CARLISLE [straight line stamp] ~~~~~~~~~~~~~~~~~~~~~ Mr. DOBSON at Edenhall ~ ~~~~~~~~~~~~~~~~~~~~~ (a Copy) Rex v. HUDSON & SIMPSON GREEN & GREEN CARTWRIGHT & anor. Ats Rex Same ——————————- Same Dear Sir / I rece~d your Letter and have entered these retainers as you desire – I have looked over your Case, and think it is such an one as deserves punishment for if such Blades as these are encouraged in practices of this Sort the warren will in time be destroyed. If you can come at the Facts stated I think Sir Philips Servts. will succeed, and you shod. endeavour to get your Indictments to hearing before theirs as all the proof rests within the Breasts of the prosecutors ~ On this Accot. I think you shod. by all means Endeavour to obtain warrants against the two GREENs - For you observe that if you shod. preferr a Bill against them the same Sessions that theirs is preferred agt. your Clients theirs will (if both be found) be tried a Sessions before yours Unless you have them under Recognizance to appear and answer the Indictmt. this Sessions. As by the tenor of the Recognizance your Clients have entered into you will be obliged to plead to the Indictmt. im~ediately but if they are not under Recognizance too you cannot compel them to plead till Midsum~er Sessions which you see will make great wide difference to you – I wod. therefore recommend to get warrts. against them and have them under Recognizance also that all may come on at the same Sessions – Nothing but not Guilty can be pleaded for every Matter of Justification or Excuse may be given in Evidence under it – I hope to be at Carlisle on the Tuesday Evening – with Complmts. to Mr. DOBSON – I am Sir your mt. obt.
